The Federal Trade Commission has reached a settlement with Epic Light Network, Inc., the maker of the popular video game Fortnite. The settlement involves two record breaking payments, the largest ever imposed on a company for violating an FTC rule.

In addition to the monetary penalty, the FTC has ordered Epic to establish a comprehensive privacy program. This program must address the problems identified in the FTC complaint and undergo regular independent audits. In addition, Epic must adopt strong privacy default settings for teens and children. And Epic must also refund consumers for billing practices.

In addition to the monetary penalties, the settlement requires Epic to delete personal information it collected from children in violation of the COPPA Rule. Additionally, Epic must obtain parental consent before enabling voice and text communications for children. It will also be prohibited from collecting data on children without their parents’ consent.

The settlement also includes a ban on implementing design tricks known as dark patterns. These tricks can be used to allow users to make purchases they were not intending to make. Epic failed to obtain consent for these practices. Moreover, the company imposed unreasonable hoops for users to jump through when they attempted to remove their data.

As part of this settlement, Epic must pay $245 million in restitution to consumers for the company’s charging and billing practices. In addition, the company must reimburse its customers for the costs of removing dark patterns, a feature that allows users to hide their real identities.
